Terms of service

By booking or purchasing photography services from me, Alissen Orrego, operating under Allyvisualz LLC, you agree to the following Terms of Service. These terms are designed to create clear expectations and protect both parties.

Services
I provide photography services with a primary focus on sports and fast-paced environments. The scope of each project, including duration, deliverables, and usage, will be agreed upon prior to the shoot.

Booking & Payment
A booking is confirmed once full payment or an agreed-upon deposit is received. Dates are not secured until payment is made. Any remaining balance must be paid before or on the day of the shoot unless otherwise agreed upon in writing.

Client Cooperation
Clients are responsible for providing accurate details regarding schedules, locations, and access. For sports photography, I am not responsible for limited athlete participation, substitutions, injuries, coaching decisions, or any factors outside of my control that may affect coverage or deliverables.

Athlete Participation Disclaimer
If an athlete participates on the field for fewer than 10 minutes, it may be impossible to portray the athlete in the manner or quantity originally expected. By booking, the client acknowledges and accepts this limitation.

Refunds & Cancellations
Refunds are not guaranteed and are evaluated on a case-by-case basis. If an athlete participates for fewer than 10 minutes and a specific number of images was purchased, one-third (1/3) of the total payment will be refunded unless otherwise agreed upon in writing prior to the shoot.

No refunds will be issued for circumstances beyond my control, including weather, access restrictions, venue rules, or limited playing time. Once images have been delivered, all sales are final.

Image Ownership & Usage Rights
All images remain the exclusive intellectual property of Allyvisualz LLC, even after payment. Clients are granted a non-exclusive license to use the images for personal, promotional, or agreed-upon purposes only.

Full ownership, exclusive rights, or commercial licensing must be purchased separately and confirmed in writing. I retain the right to use all images for portfolio, marketing, social media, website content, editorial use, and other media outlets unless otherwise agreed upon in writing.

Editing & Delivery
Images are edited at my discretion and reflect my creative style. Clients may not alter, edit, filter, crop, or manipulate images without written permission.

Limitation of Liability
I am not liable for missed moments, reduced coverage, or compromised results due to factors beyond my control, including but not limited to weather, venue restrictions, athlete availability, equipment failure beyond reasonable safeguards, or event changes.

Governing Law
These Terms of Service are governed by the laws of the State of New York.

By booking my services, you confirm that you have read, understood, and agreed to these Terms of Service.
